Oversize/Overweight Permit Application

An Oversize/Overweight Permit is required for any load, vehicle, object or structure that is oversize and/or overweight as defined by the Highway Traffic Act, as amended. 

The application must be submitted to the Township at least one (1) week prior to the start date. Please review the General Conditions of the permit at the bottom of this form.

The Applicant will be notified when the permit has been approved and provided with a signed copy.

Where Standard Annual Weights are selected, the following blanket allowable weights will apply:

Authorized weights for the transportation of indivisible loads:

a) Weight on tires less than 350mm wide may not exceed 11kg per mm width as embossed on the tire sidewalls; tires greater than 350mm wide may not exceed 10kg per mm width as embossed on the tire sidewall;

b) Weights shall not exceed the Manufacturers Rated Capacity of any vehicle or tire component;

c) Weight limit on a single axle other than a front axle shall be as per HTA plus 5,000kg; Axles equipped with single tires may not exceed 9,000kg; 

d) Weight limit on tandem axles or two axle groups shall be as per HTA plus 7,000kg;

e) Weight limit on all other axle units and groups;

  • with a total spread of less than 3.6m shall be as per HTA plus 9,000kg;
  • with a total spread of 3.6m or greater shall be as per HTA plus 10,000kg

f) Gross weight limit for:

  • Tractors drawing a two axle trailer: 55,000kg;
  • Tractors drawing a trailer having three or more axles with a base length of equal to or less than 16.5m, the lesser of HTA Reg 413/05 plus 10,000kg or 63,500kg;
  • Tractors drawing a trailer having three or more axles with a base length greater than 16.5m, the lesser of HTA Reg 413/05 plus 13,000kg or 63,500kg;

g) RGW at least the lesser of 63,500kg or actual gross vehicle weight.

The permit holder is entitled to overweight privileges when a reduced load period is in effect subject to the lesser of the above weight restrictions or a maximum of 7,700kg per axle with single (two) tires and 10,000kg per axle with dual (four) tires. Overweight privileges are prohibitied on all highways designated as being subject to reduced loading and posted as such in accordance with Ontario Regulation 615.

General Conditions

  1. The applicant understands that under the provision of subsection 110(5) of the Highway Traffic Act the owner, operator or mover of a heavy vehicle, load, object or structure in respect of which a permit is granted under this section who has obtained a permit is nevertheless responsible for all damages that may be caused to the highway, by reason of the driving, operating or moving of any such heavy vehicle load, object or structure.
  2. Vehicles and loads in excess of the width and/or length prescribed under section 109 of the Highway Traffic Act shall be marked with four (4) or more flags, one as near as practicable to each corner of the vehicle or load. The flags shall be bright in colour, and be a minimum of 400mm square. Where the flags are at the rear of the vehicle or load, they shall not be less than 2 meters above the road surface. Where a vehicle or load is wider at any point or points on either side than at the corner, it shall be where practicable, be so marked with such a flag at the widest point on each side.
  3. Vehicles and loads in excess of the length prescribed under section 109 of the Highway Traffic Act shall in addition to the flags required under condition 2, display on the rear, in a clearly visible position a sign bearing the words "LONG LOAD" in black letters at least 200mm high with lines forming in letters at least 30mm wide on a yellow background.
  4. Where a permit is issued on the condition that the permit holder provide escort protection, the escort vehicles shall precede the vehicle and load on a two lane highway or follow the vehicle and load on a four lane highway at a distance of 150m bearing a sign reading "CAUTION OVERSIZED LOAD FOLLOWS" or "CAUTION OVERSIZE LOAD AHEAD" as the case may be in black letters at least 200mm high with lines forming the letters at least 30mm wide on a yellow background.
  5. The Township of West Lincoln reserves the right to determine when private or police escorts are required dependent on the agreed route.
  6. The applicant agrees to indemnify and save harmless the Township of West Lincoln from any action, claim, damage, or loss whatsoever, arising from the operation carried our under this permit. Prior to undertaking any move in this regard, the applicant shall deposit with the Township a form of insurance naming The Corporation of the Township of West Lincoln as an additional insured on the the policy. A minimum of $5,000,000.00 General Liability insurance per occurance is required.
  7. The permit is only valid for the listed road sections that are under the jurisdiction of the Township of West Lincoln. Separate permits must be obtained from other jurisdictions where the roads are impacted by the travel route (e.g. Niagara Region, Ministry of Transportation).
  8. The use of any road or structure may be restricted at any time.
  9. This permit may be withdrawn upon written notice at any time by the Township.
  10. Notwithstanding the issuance of this permit, the operator/carrier is subject to all applicable laws and regulations within the Province of Ontario.
  11. This permit must be carried in the vehicle at all times.
  12. This permit is not valid:
  • on Ministry of Transportation Highways
  • on roads under the jurisdiction of the Niagara Region
  • on roads or structures otherwise restricted by a Municipal By-law.
